Article 1 – Definitions

 

The following terms used in these terms and conditions, whether in the singular or plural, shall have the following meaning:


CUSTOMER: Refers to any Subscriber, Member and VIP Member who has placed an Order on the Site.


MEMBERSHIP: All the services offered exclusively to Members or VIP Members according to their subscription level;


ORDER: Refers to any purchase of one or more products made by a Subscriber, Member or VIP on the Website under the conditions set out in these General Terms and Conditions of Sale;


PERSONAL ACCOUNT: Refers to the Subscriber's account after registration to the services;


EVENT: Refers to all events of any kind organised by Arlettie as part of the services;


SUBSCRIBERS: Refers to any natural person, not a contributor, using the services and accepting the present general Terms and Conditions as well as the Arlettie general Terms and Conditions which can be consulted here;


BRAND: Refers to the Arlettie partner whose products and / or services are the subject of the events;


MEMBER: Refers to any natural person who is a member of the Membership and whose membership is subject to the special conditions for members;


VIP MEMBER: Refers to any natural person who is a member of the Membership and whose membership is subject to the special VIP member conditions;


SERVICES: Refers to all the services offered to members and described in article 5. VIP members benefit from exclusive services whose conditions are described in the applicable special conditions;


The terms below used in these general conditions, used in the singular as well as in the plural, will have the following meaning:


PERSONAL ACCOUNT: Refers to the registrant's account after registering for the services;


ARLETTIE SPACES: Designates the places where the programmed events take place during the duration of the events;


SALES: Refers to all sales of any kind organised by Arlettie (including but not limited to sales, inaugurations, etc.) as part of the services;


SITE: website accessible at https://shop.arlettie.com/en

 

Article 2 - Application and enforceability of the general conditions

 

The purpose of these general conditions is to define the conditions of access and use of the services offered to subscribers and the rights and obligations of subscribers when using the services.



Access to sales is subject to prior registration to Arlettie services.



Registration for the services implies full and unreserved acceptance of the contractual documents which the subscriber declares to have read and understood in their entirety and which are as follows, listed in ascending order of priority and forming an indivisible whole:



- The current terms and conditions, including the privacy policy at the bottom of each page of the website;
- The special terms and conditions applicable to VIP Members if the customer is a member of this offer;
- For cross-border orders, Global-e terms and conditions are also applicable



If there is a contradiction between documents of a different nature or of different rank, the conditions contained in the document of higher rank shall prevail for the obligations in a conflict of interpretation. In case of contradiction between the terms of documents of the same order, the latest documents shall prevail over the others.



Any order placed on https://shop.arlettie.com/en requires the prior and unrestricted acceptance of these General Terms and Conditions of Sale, which are subject to French law. The fact that the user ticks the box: "I have read and accept the general terms and conditions of sale" therefore means that he/she has read and accepted these general Terms and Conditions. If the Customer does not tick the box provided for this purpose, he/she will not be able to place an order.



Arlettie has the right to adapt or modify the present general conditions of sale at any time.. The general Terms of sale applicable are those used on the day of your order. By placing an order on https://shop.arlettie.com/en, the Customer attests that he/she is an individual of legal age who is not a merchant and is acting for his/her personal needs; he/she acknowledges that he/she has the full capacity to commit to these general terms and conditions of sale when making transactions on www.arlettie.com/en.

 

Article 3 - Registration conditions - Terms of access to services

 

Registration is exclusively intended for individuals of legal age. Minors are invited to inform the persons who have parental authority over them of their subscription and participation in sales.



Only one account can be opened per person, Arlettie has the right to refuse the opening of an account requested by any person who has already been registered.
The services cannot be granted to a professional and/or to any person selling or likely to sell the products purchased during the sales organised by Arlettie or more generally, benefiting from the advantages offered for purposes other than personal and private.



Any person wishing to register must first accept the present general Terms and Conditions in their latest version.



Registration for the services is done by filling in an online registration form directly on www.arlettie.com/en by following the steps below:


- Go to the Home Page of www.arlettie.com/en
- Click on the REGISTRATION link, located at the top right of the page
- Fill in all the information and validate the form

Once you have completed in these steps, you will belong to the Arlettie community of Subscribers.



The subscriber acknowledges that Arlettie has the right to suspend or withdraw access to the services if the subscriber fails to comply with these registration Terms and conditions and, in particular, if the subscriber provides false, inaccurate, incomplete, illegible or out-of-date data.


The subscriber also acknowledges that Arlettie has the right to refuse the registration of any person previously registered and/or whose registration has been closed by Arlettie due to a breach of these Terms and Conditions.



The methods of processing personal data are mentioned in article 9 of these general conditions of sale.

 

Article 4 - Ordering on the Website - Acceptance of the offer

 

The website is accessible 7 days a week and 24 hours a day, except for maintenance operations.
Sales are accessible on the days and at the times communicated to Subscribers, Members and VIP Members. These dates and times are sent by e-mail and are also available on the website.

 

Approval and confirmation of the order on our website are subject to prior registration, as described in Article 3 of these conditions, as well as compliance with the day and times defined for each sale.



The approval and confirmation of the order are carried out by several data fields on successive screens:



- Logging into your personal account with your registered e-mail address and password
- Choose the E-SHOP link which can be located in the menu at the top of the page; and access to the current sale
- Select the items and adding them to the shopping cart
- Validate the order basket and approve the General Terms of Sale
- Enter the contact details + confirming the shipping method
- Pre-contractual information
- Choose and confirm the payment method



Arlettie has the right to limit the number of items (or item category) per basket and per customer account in order to satisfy the greatest number of customers.



Before any validation, the customer will have been informed of the delivery times, under Article L.111.1 of the French Consumer Code.
As soon as the Customer's payment has been accepted, you will receive an e-mail confirming the order and summarizing all the items ordered, the billing and delivery address and the delivery date.

 

The validation and confirmation of the order are sent by email to the customer from Arlettie, and following the approval of payment, are considered the conclusion of the sales contract between the two parties, and the adherence to the General Terms and Conditions.

 

Article 5 - Payment

 

The price of each product, shown on the Website, is agreed to include all taxes, to which may or may not be added delivery costs and Duties and Taxes applicable, which will be indicated to the Customer before the final validation of the order.
The reference price (crossed out), indicated next to the sale price, is the price recommended by the supplier of the product to distributors in France (or other countries if it has been specified by the supplier) at the time of sale.

 

The price of the items purchased is to be paid in totality on the day the order is placed by the Customer.

 

Payment is made online by credit card (Carte Bleue, Visa, Eurocard/Mastercard, American Express or any other specific payment method offered in each country) at the time of the order validation by the Customer.

 

The request for debit card authorisation is made at the time of validation of the order on the Website except in the event of unavailability of servers. Arlettie has the right to proceed with a new direct debit authorization request in the event that the first one could not be completed due to server unavailability.



In the event of non-payment, incorrect address or any other problem with the Customer's account, Arlettie has the right to block the Customer's order until the problem is resolved.



Arlettie uses all necessary means to ensure the confidentiality and security of banking data transmitted on the website. The website is provided with a system for securing online payments that encrypts the Customer's data.

 

The payment information is transmitted according to the highest security standards. The transmission of banking data is guaranteed by Arlettie's partner: Shopify Payment or Global-e for other cross-border orders.
Shopify Payment or Global-e payment method are a technical service provider; as such, it does not handle any complaints related to orders, which are handled directly by Arlettie.



All information exchanged to process the payment is encrypted using SSL (Secure Socket Layer) protocol: this data cannot be detected, intercepted or used by third parties. At no time does the Customer's financial data pass through Arlettie's computer system. Shopify Payment and Global-e ensure that the connection with the Customer's browser is secure before sending the payment form to the banking institution that carries out the financial transaction.



The Customer has the option of choosing PayPal to pay for their order. After choosing this payment method, the Customer will be redirected to the PayPal website. The Customer will have to insert his identifiers and proceed with the payment.

 

In accordance with the provisions of Article L.221-11 of the French Consumer Code, the Customer will receive written confirmation of the price paid, detailing the price per item and the delivery costs if any payable by the customer, at the latest upon delivery.  

 

Article 6 - Delivery

 

The products will be delivered to the address indicated by the Customer on the order form, in metropolitan France (including Corsica). By default, invoices are sent to the e-mail address indicated by the Customer when confirming the order.
If the procedures set out below are not respected, no claim from the Customer will be accepted.



Arlettie offers the following types of delivery for France:
- Standard delivery – €6

For this "standard" delivery, Arlettie will deliver the order(s) within a maximum of three (3) working days from the day following the payment of the order.

For all other countries, Arlettie offers the following type of delivery with different delivery costs applied:

Switzerland: 7 days – 10 CHF

Europe: 7 days - €10

 

 
The customer will then receive an order confirmation email with a delivery note.
Once the order has been handed over to the carrier (shipped status), a link allowing the Customer to track the package will be sent to the Customer by e-mail.
From the moment of delivery, the risks are transferred to the Customer.

 

If the delivery time is exceeded and is not justified by a case of force majeure, the Customer may request - if he/she so wishes - the cancellation of the order and can obtain a refund of the sums paid for the order within a maximum period of thirty (30) days.

 

Article 7 - Product returns

 

7.1. Exercise the right of withdrawal

Withdrawal period - exclusions from the right of withdrawal

 

You have a right of withdrawal of fourteen (14) calendar days from the date of receipt or collection of your entire order.

 

The 14-day period mentioned above runs from the day after the delivery of the order validated by the Customer. This 14-day period starts at the first hour of the day following the day of delivery and ends at the end of the last hour of the last day of the 14 days.

 

If this period expires on a Saturday, Sunday or public holiday, it shall be extended to the next working day.

 

During this period, you may return undamaged Products without having to give any reason or pay any penalty. In case of damaged Products received, the procedure in article 7.2 will apply.

 

The Products must be returned in their original condition, suitable for resale, in their original packaging, intact and complete. They must not have been worn and must be returned with all accessories, instructions and documentation.

 

All Products can be returned, except those excluded by French law in article L221-28 of the Consumer Code, for example, Products that have been personalised at your request, Products that have been opened and cannot be returned for reasons of hygiene (e.g.: tights worn), etc...

 

Withdrawal/return procedures

 

To exercise your right of withdrawal, you can use the standard withdrawal form available in the "My Account" area or make any unambiguous statement indicating your intention to return the Product to Arlettie, in particular by declaring your return online from your account, under the heading "return and withdrawal".

 

Arlettie will acknowledge receipt of your withdrawal and will allow you to edit your return form.

 

You must then return the Products to Arlettie, together with the issued return form, at the latest within fourteen (14) days following your withdrawal, either:

By DHL for all cross-border orders

In one of the proposed drop-off points, with the forwarding note that will be sent to you by email for all relevant countries.

 

Return shipping costs are at your charge. The cost of the pre-paid label on your return slip will be deducted from your refund.

 

France: €6

United Kingdom: £15

Switzerland: 15 CHF

Europe: €10

United States: $20

 

For all other countries (except those mentioned above): €20 (converted into the local currency)

 

When an order has been placed with a discount linked to the simultaneous purchase of a predetermined number of items, the return of one or more items by the Customer may have the effect of terminating the discount, when the number of items necessary for the application of this discount is no longer reached.

 

The refund made to the Customer will take into account, if applicable, the fact that the discount is no longer applicable and the difference will therefore be deducted from the amount refunded to the Customer for the returned items.

 

Arlettie agrees to refund the totality of the sums paid (excluding return costs) within 5 to 7 working days after receipt of the Product in its warehouses. This period may be extended in the event that the return form does not correspond to the returned order or in the absence of the product at the following address:

The refund will be paid via the payment method used for the returned order.

 

Any risk related to the return of the product is at the expense of the Customer.

 

If the above procedure is not followed and the time limits indicated are not respected, the Customer will not be able to make any claim for missing or non-conforming products or visible defects in the products delivered, as the products will then be in conformity and free of any visible defect.

 

7.2. Special case of a non-conforming Product

 

Arlettie advises you to check the Product at the time of delivery and if the Product delivered does not conform (error in the Product, defective, damaged or incomplete Product), to make written reservations at the latest within three (3) days following this delivery, to Arlettie's customer service at contact.online@arlettie.fr.

 

In all cases, the Terms of article 8.1 on legal guarantees will apply. Thus, the Product delivered that does not conform can only be replaced if it is available. Nevertheless, if the new Product received does not suit you, you may exercise your right of withdrawal within the remaining period.

 

For Products notified as not conforming within three (3) days of delivery, Arlettie allows you to exercise your right of withdrawal and obtain a refund of the Product in accordance with the provisions of Article 7.1, without going through the exchange.

 

7.3. Lost package 

 

If, within seven (7) working days following the dispatch of the order, the Customer has still not received the parcel, nor a delivery notice, nor precise information via the online tracking of the parcel, he/she must go to his/her nearest post office or to his/her collection point with the tracking number of the parcel in his/her Customer account, notably in the confirmation email sent to him/her at the time of dispatch.

 

If the transporter does not find any trace of the order, the buyer must contact Arlettie's customer service as soon as possible, either by email at the following address: contact.online@arlettie.fr or by telephone at +33 1 88 40 36 30 for French customers and at +44 330 818 7917 for UK customers.

 

Arlettie's customer service will then open a case with the carrier and the Customer will receive an e-mail informing him/her that a case has been opened.

 

If the order is found, it will be immediately returned to the Customer who will be immediately informed. If the order is considered lost, Arlettie will refund the total amount of the order within fourteen (14) days from the end of the case.


Article 8 – Guarantee

 

8.1 Legal guarantees

 

All Products sold on the Website are covered by the legal guarantee of conformity (articles L217-1 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code), allowing you to return defective or non-compliant Products. 

 

You have a period of two years from the date of delivery of the Product to take action under the legal guarantee of conformity. In this case, you may choose between repairing or replacing the Product, depending on the cost conditions set out in Article L217-9 of the French Consumer Code, and depending on available stocks. If these two solutions are impossible to carry out within 30 days of the Customer's request, Arlettie will proceed with a full refund against return of the product.

 

It is reminded that the legal guarantee of conformity applies independently of any commercial guarantee that may be granted by the manufacturer or Arlettie.

 

Furthermore, if the Customer decides to invoke the guarantee against hidden defects of the item sold within the Terms of Article 1641 of the Civil Code, he/she may choose between the withdrawal of the sale or a reduction of the sale price. It is up to the Customer to prove that the defect existed before the delivery of the product and was not apparent at the time of delivery.

 

8.2. Commercial guarantees 

 

The items sold online by Arlettie cannot give rise to a commercial guarantee known as manufacturer's guarantee since Arlettie is not a partner. Thus, all the products put online are exclusive of the commercial guarantee.

Therefore, no buyer can ask to benefit from this guarantee. The manufacturer's guarantee may be indicated on the product description page during the sale on the Arlettie website. The scope and period of this commercial guarantee varies according to the brands and manufacturers.

 

The contractual guarantee granted by the manufacturer is the one usually granted by the supplier to its customers. In any case, Arlettie cannot be responsible if the manufacturer refuses to apply its guarantee.

 

In any case, the commercial guarantee will be refused to any product modified, repaired, integrated or added by the buyer or any other person not authorised by the supplier of this product or service. The guarantee will also not cover products damaged in shipping or by incorrect use.

 

Article 9 - Personal data

 

In order to provide you with the best customer service, and to manage customer relations, we need to collect personal data (such as your name, postal address, e-mail address, telephone number, date of birth, etc.) that you provide to us or that we obtain from you during your purchases. Some of this information is essential for the processing and delivery of your orders or for your membership card. This essential data is identified by an asterisk. All this information is for internal use only. We will only keep your data for as long as it is necessary to perform our services or as long as we are required to do so by law. All elements of the arlettie.com/en website with or without a trademark registration (photos, product sheets, descriptions, layout...) are the exclusive property of Arlettie and may not be used.

 

All trademarks, visual or audio texts, comments, works, illustrations, and images reproduced on the Arlettie website are protected under copyright, trademark law and image rights.

 

They are the full and complete property of Arlettie or its partners. Any reproduction or representation, in whole or in part, constitutes an infringement that may engage the civil and criminal liability of its author.

 

The user who has a website, blog and who wishes to place, for any use, a simple link referring directly to the home page of the Arlettie website, must request authorization from the company ARLETTIE ONLINE. Any hypertext link to the Arlettie website using the "framing" or "in-line linking" techniques is strictly forbidden. In any case, any link, even tacitly authorized, must be removed on simple request from the company.

 

Article 12 - Force majeure

 

Force majeure events, as defined by French legislation and case law, which make it impossible for Arlettie to execute the sales contract under the conditions provided for, constitute a cause for suspension or extinguishment of Arlettie's obligations.

 

Arlettie cannot be responsible for the non-execution of the contract concluded in the event of the occurrence of one of the events mentioned above.

 

If the event of force majeure continues beyond one month from its occurrence, the Parties may notify each other, by registered mail with acknowledgement of receipt, of the cancellation of the order without any right to compensation on either side.

 

Article 13 - Mediation - Applicable law and competent jurisdiction

 

In the case of a conflict resulting from the present contractual relationship, the parties undertake to find an amicable solution before taking any legal action. In accordance with article L.152-2 of the Consumer Code, the Customer is informed that he/she has the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or to any other alternative method of settling a conflict.

The competent court in the case of a dispute will be that of the defendant's place of residence.

The website www.arlettie.fr on which the Event takes place (hereinafter referred to as the "Site" or "Arlettie Site") is published by the company ARLETTIE ONLINE, SAS with a capital of €10,000, RCS PARIS 841 311 731, whose registered office is located at 17 Avenue Raymond Poincaré - 75116 Paris and which is registered in the Paris Trade and Companies Register under number 348 626 391 (hereinafter referred to as "Arlettie").

 

Access to the Event implies unconditional acceptance of these conditions, which aim to define the terms of distance selling between Arlettie and the Customer, from the order to payment and delivery, which are specific to the Event (the "General Sales Conditions").

 

 

Montblanc’s customer service department is not authorized to answer questions or requests relating to a Product purchased as part of the Event, only Arlettie's customer service department is authorized to do so.

Article 1 - Terminology

 

The following terms used in these Terms and Conditions, whether in the singular or plural, shall have the following meaning:

CUSTOMER: Refers to any Subscriber who has placed an Order on the Site.

ORDER: Refers to any purchase of one or more Products by a Subscriber on the Site under the conditions set out in these General Terms of Sale.

 

PERSONAL ACCOUNT: Refers to the Subscriber's account after registration to Arlettie services;

 

EVENT: Refers to the eventual sale of Products organized by Arlettie from Monday, November 18th 2024 at 7:00am to Tuesday, November 19th 2024 at 23:59 and accessible on the Site via the invitation link communicated by Arlettie;

 

REGISTERED : Refers to any Employee or guest of Employees who, in order to access the Event, registers with Arlettie after having received a personal invitation from Arlettie to participate and access the Event; uses the services and in this context accepts these General Terms and Conditions of Sale as well as Arlettie's general terms and conditions of use, which can be consulted here (it being specified that the Employee's registration to Arlettie's services, for the purposes of accessing the Event, must be carried out using his or her professional email address);

 

PRODUCT: Refers to any Montblanc branded product offered for sale at the Event. Please note that the Products may have minor imperfections (such as scratches, tarnish, other marks or minor defects) which - although not significantly affecting the use of the Products concerned - will not be detailed on the Products' presentation page. This will not affect your rights under applicable law;

 

EMPLOYEE: Any natural person residing in Europe who is an employee of Montblanc and Richemont and their guests on the date of the Event, who has received an invitation link to the Event from Arlettie;

 

SERVICES: Refers to all services offered to Subscribers by Arlettie in the context of using the Site, accessing the Event and placing an Order.

 

Article 2 - Application and enforceability of the general conditions

 

The purpose of these General Terms and Conditions of Sale is to define the conditions of access and use of the Services offered to Subscribers and the rights and obligations of Subscribers when using the Services to access the Event and place an Order for Products in this context.

 

Access to the Event is subject to prior registration to the Services through the Employee's use of his or her business email address.

 

Registration for the Services implies full and unreserved acceptance of the contractual documents, which the Subscriber declares to have read and understood in their entirety, and which are the following, listed in ascending order of priority and forming an indivisible whole:

 

- These Terms and Conditions, including the privacy policy at the bottom of each page of the Site;

- Terms of use of the Services ;

 

Any Order of Products within the framework of the Event implies the prior and unconditional acceptance of these General Terms and Conditions of Sale, which are subject to French law. The fact that the Subscriber ticks the box: "I have read and accept the general terms and conditions of sale" therefore means that he/she has read and accepted these General Terms and Conditions of Sale. If the Subscriber does not tick the box provided for this purpose, he/she will not be able to place an Order.

 

Arlettie reserves the right to adapt or modify these Terms and Conditions at any time. The General Terms and Conditions of Sale applicable are those in force on the day of the Order. By placing an order for Products on the Site, within the framework of the Event, the Customer certifies that he/she is an individual of legal age who is not a consumer and that he/she is an Employee, or a guest of the Employee acting for his/her own personal needs and acknowledges that he/she has the full capacity to commit to these General Terms of Sale.

 

Any breach of the provisions of these Terms and Conditions by the Employee or his/her guest and/or any disrespectful, abusive, rude or inappropriate exchange with Arlettie's customer service department may result in the cancellation of any unsent Orders and/or a ban on access to the Event or any subsequent sales and/or disciplinary action, of which your line manager will be informed, up to and including dismissal.

 

 

Article 3 - Conditions of registration - Terms of access to services

 

Registration for the Services is done by completing an online registration form accessible via the invitation link received by the Employee. Employees are required to use their work email address to register for the Services and access the Event.

 

Only one account may be opened per Employee, and Arlettie reserves the right to refuse the opening of an account requested by any Employee who has already been registered.

 

The invitation to the Event and login details are strictly personal to each Employee and must not be shared or transferred to any third party. Registrants (Employee and his/her guest(s)) also agree not to post any content or comments relating to the Event on social networks or any other customer experience platform or website. Failure to comply with the foregoing may result in the cancellation of any unshipped Orders and/or a ban on access to the Event or any subsequent sales and/or disciplinary action, of which your manager will be informed, up to and including dismissal.

 

The Subscriber acknowledges that Arlettie reserves the right to suspend or withdraw access to the Services and the Event if the Subscriber fails to comply with these registration terms and conditions and, in particular, if the Subscriber provides false, inaccurate, incomplete, illegible or out-of-date information. The Subscriber also acknowledges that Arlettie reserves the right to refuse the registration of any person who has previously registered and/or whose registration has been terminated by Arlettie due to a breach of its terms and conditions.

 

The methods of processing personal data are mentioned in article 9 of these General Terms and Conditions of Sale.

 

Article 4 - Ordering on the Site - Acceptance of the offer

 

The Event is scheduled to be accessible from from Monday, November 18th 2024 at 7:00am to Tuesday, November 19th 2024 at 23:59, but may be cancelled, deleted or modified at any time.

 

Acceptance and confirmation of the Order on the Site are subject to prior registration, as described in Article 3 of these conditions, and to compliance with the day and time defined above.

 

Acceptance and confirmation of the Order is achieved by a series of data entries on successive screens:

 

- Login to your personal account with your work email and password

- Access to the Event

- Selection and addition of the chosen Products to the basket (within the limits provided below)

- Validation of the order basket and acceptance of these General Terms and Conditions of Sale

- Entering contact details + confirming the type of delivery

- Pre-contractual information

- Choice of payment method and confirmation of choice of payment method

 

 

For the purposes of the Event, and in particular in view of the quantities available, each Employee or Guest is authorized to purchase a maximum of 5 pens (including writing instruments sets) for the duration of the Event. It is your responsibility to comply with these limits, failing which you will be subject to the cancellation of any orders not dispatched and/or a ban on access to the Event or any subsequent sales and/or disciplinary action, of which your line manager will be informed, up to and including dismissal. Any other discounts, including but not limited to the discounts employed, will not apply.

 

The Product(s) purchased at the Event are exclusively for the personal use of the Customer or his/her immediate family (parents, parents-in-law, spouse/partner, siblings, children/children-in-law), or to be given by the Customer as a personal gift (i.e., without reimbursement) to a third party. Only members of the Customer's immediate family (mentioned above) may reimburse the Customer for the price of the Product(s) purchased by the Customer for their personal use. In all other cases, the resale of Products purchased at the Event is strictly prohibited and may result in disciplinary action up to and including dismissal. Any Employee suspected of offering Products sold at the Event for sale on WeChat, eBay or similar sites will be subject to a disciplinary investigation and your supervisor will be informed.

 

Before any validation, the buyer will have been informed of the delivery times, in accordance with article L.111.1 of the Consumer Code.

 

As soon as the Customer's payment has been accepted, you will receive an e-mail confirming your Order, summarizing all the Products ordered, the billing and delivery address and the delivery date.

 

The validation of the Order by the Customer and the confirmation of the Order sent to the latter by e-mail by Arlettie, following the acceptance of the payment, shall constitute the conclusion of a sales contract between the parties and acceptance of these General Terms of Sale.

 

Article 5 - Payment

 

The price of each Product, displayed on the Website, is understood to include all taxes for the member countries of the European Union and to be inclusive of tax for Switzerland and the United Kingdom, to which may not be added delivery costs. The Products ordered do not give rise to any tax refund.

 

If there is a reference price (crossed out) next to the sale price, this is the price at which the Product was originally offered for sale by Montblanc (in-store or online) or a Montblanc distributor.

 

The price of the Products purchased is payable in full on the day the Order is placed by the Client.

 

Payment is made online by credit card (Carte Bleue, Visa, Eurocard/Mastercard, American Express) at the time of validation of the Order by the Customer. Payment by means of a Montblanc gift card is not accepted.

 

The direct debit authorization request is made at the time of the Order validation on the Website, except in case of server unavailability. Arlettie reserves the right to make a new direct debit authorization request in the event that the first one could not be completed due to server unavailability.

 

In the event of non-payment, incorrect address, or any other problem with the Customer's account, Arlettie reserves the right to block the Customer's Order until the problem is resolved. 

 

Arlettie uses all necessary means to ensure the confidentiality and security of banking data transmitted on the Site. The latter is equipped with an online payment security system that encrypts the Customer's data. The payment information is transmitted according to the highest security standards. The transmission of banking data is guaranteed by Arlettie's partner: Shopify Payment for France and Global-E for all other countries, are technical service providers; as such, they do not handle disputes related to Orders, which are handled directly by Arlettie.

 

All information exchanged to process the payment is encrypted using SSL (Secure Socket Layer) protocol: this data cannot be detected, intercepted, or used by third parties.

 

At no time does the Customer's financial data pass through Arlettie's computer system. Shopify Payment for France and Global-E for all other countries, check that the connection with the Customer's browser is secure before sending the payment form to the banking institution that carries out the financial transaction.

 

The Customer has the possibility to choose PayPal to pay for his/her order. After choosing this payment method, the Customer will be redirected to the PayPal website. The Customer will have to insert his identifiers and proceed with the payment.

 

In accordance with the provisions of article L.221-11 of the Consumer Code, the Customer will receive, at the latest at the time of delivery, for each of the Products, written confirmation of the price paid detailing the price of the Products and the delivery costs, if any, payable by the Customer.

 

 

Article 6 - Delivery

 

The Products will be delivered to the address indicated by the Customer at the time of purchase. Customer must only use a personal address for the delivery. It will not be possible to collect the Products from any professional address (Richemont office or any brand’s shop).

 

For the delivery, Arlettie will deliver the order(s) within a maximum of fourteen (14) calendar days from the day following the payment of the Order.

 

The Customer will then receive an Order confirmation email with a delivery note.   

                                                                     

Once the Order has been handed over to the carrier (dispatched status), a link allowing the Customer to track the package will be sent to the Customer by e-mail.

 

All Products will be shipped with packaging.

 

From the moment of delivery, ownership of the Products and the associated risks are transferred to the Customer.

 

If pieces or all of the Order cannot be dispatched for any reason, the Customer will be informed and the balance due will be refunded within seven (7) working days of the cancellation or modification of the Order, if applicable.

 

If the delivery time is exceeded and not justified by a case of force majeure, the Customer may request - if he/she so wishes - the cancellation of the sale and obtain a refund of the sums paid for the sale within a maximum period of seven (7) days.

 

 

Article 7 - Return of Products

 

7.1. Exercising the right of withdrawal

 

Withdrawal period - exclusions from the right of withdrawal

 

In our efforts to reduce waste, we would like to point out that it is important for you to consider the impact of your purchases and not to buy more Products than you are likely to want to keep and return after the Event. Please consider your purchases before placing your Order.

 

You have a right of withdrawal of fourteen (14) calendar days from the date of receipt of your entire Order.

 

The above-mentioned 14-day period shall run from the day after the delivery of the Order validated by the Customer. This 14-day period shall begin on the first hour of the day following the day of delivery and shall end on the expiry of the last hour of the last day of the 14-day period.

 

If this period expires on a Saturday, Sunday or public holiday, it shall be extended until the next working day.

 

During this period, you may return undamaged Products without having to justify your reasons or pay a penalty. In case of damaged Products received, the procedure in article 7.2 will apply.

 

The Products must be returned in the condition in which you received them, in their original packaging, intact and complete. They must not have been sent with extended shipping and must be accompanied by all accessories, instructions and documentation.

 

Withdrawal / return policy

 

To exercise your right of withdrawal, you can use the standard withdrawal form available in the "My Account" area or make any unambiguous statement indicating your intention to return the Product to Arlettie, in particular by declaring your return online from your account, under the heading "return and withdrawal".

 

Arlettie will acknowledge receipt of your withdrawal and will issue your return slip.

 

You must then return the Products to Arlettie, together with the issued return slip, no later than fourteen (14) days after your withdrawal, either:

Arlettie undertakes to reimburse the total amount paid (within 5 days of receiving the Product in its warehouses. This period may be extended if the return form does not correspond to the returned Order or in the absence of the latter at the following adress.

 

The refund will be made via the same payment method used for the returned Order.

 

Any risk associated with the return of the Product is the responsibility of the Customer. It is the responsibility of the Customer to ensure that the Products are returned to the correct address and in good condition.

 

7.2. Special case of a non-conforming Product

 

Arlettie advises you to check the Product at the time of its delivery and if the delivered Product is not compliant (error of the Product, defective or damaged Product beyond the minor imperfections mentioned in article 8.1 of the present General Terms of Sale or incomplete), to make written reservations at the latest within three (3) days following this delivery, to Arlettie's customer service at the address guest@arlettie.fr.

 

In all cases, the provisions set out in Article 8.1 on legal guarantees shall apply, it being specified that, given the imperfections, the Product delivered that does not conform shall only be subject to a refund (and not to an exchange or repair).

 

To enable you to obtain all necessary assistance in the event of delivery of non-conforming or missing Products, please ensure that you retain the package in which the Products were delivered, as well as any documents and emails relating to your Order. 

 

7.3. Lost parcel

 

If, within seven (7) working days following the dispatch of the Order, the Customer has still not received his/her parcel, neither a delivery notice nor precise information via the online tracking of his/her parcel, he/she must go to his/her nearest post office or parcel delivery point with the tracking number of the parcel in his/her Customer account, particularly in the confirmation email sent to him/her when the parcel was dispatched.

 

If the carrier finds no trace of the parcel, the Customer must contact Arlettie's customer service as soon as possible, either by email at the following address: guest@arlettie.fr or by telephone at:

Arlettie's customer service will then open an investigation with the carrier and the Customer will receive an e-mail stating that an investigation has been opened.

 

If the parcel is found, it will be immediately returned to the Customer who will be immediately informed. If the package is considered lost, Arlettie will refund the total amount of the Order within fourteen (14) days from the end of the investigation.

 

Article 8 - Guarantee

 

All Products sold on the Website benefit from the legal guarantee of conformity (articles L217-1 and following of the Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the Civil Code), allowing you to return defective or non-compliant Products.

 

You have a period of two years from the date of delivery of the Product to act under the legal guarantee of conformity.

 

In this case, given that the Product is specific in that it has imperfections, you can only obtain a refund against return, and not a repair or replacement in the absence of available stocks of an identical Product.

It is up to the Customer to prove that the defect (other than imperfections of the Product existing at the time of delivery) existed before the delivery of the Product and was not apparent at the time of delivery.

Article 11 - Intellectual property

 

All elements of the arlettie.fr site, whether they have been the subject of a trademark registration (photos, product sheets, descriptions, layout, etc.) are the exclusive property of Arlettie or its partners and may not be used. All trademarks, visual or audio texts, comments, works, illustrations, and images reproduced on the Arlettie website are protected by copyright, trademark law and image rights. They are the full and complete property of Arlettie or its partners.

 

Any reproduction or representation, in whole or in part, constitutes an infringement that may incur the civil and criminal liability of its author. The user who has a website, blog and who wishes to place, for any use, a simple link referring directly to the home page of the Arlettie website, must request authorisation from the company ARLETTIE ONLINE. Any hypertext link to the Arlettie website using the "framing" or "in-line linking" techniques is strictly forbidden. In any case, any link, even tacitly authorised, must be removed on simple request from the company.

 

Article 12 - Force majeure

 

Events of force majeure as defined by French legislation and jurisprudence that make it impossible for Arlettie to execute the sales contract under the conditions provided for constitute a cause for suspension or extinction of Arlettie's obligations. Arlettie cannot be held responsible for the non-performance of the contract concluded in the event of the occurrence of one of the above-mentioned events.

 

If the force majeure event continues beyond one month from its occurrence, the Parties may notify each other by registered letter with acknowledgement of receipt of the cancellation of the Order without any right to compensation on either side.

 

Article 13 - Mediation - Applicable law and jurisdiction

 

In the event of a dispute arising from the present contractual relationship, the parties undertake to seek an amicable solution before any legal action is taken. In accordance with Article L.152-2 of the French Consumer Code, the Customer is informed that he/she has the possibility of resorting, in the event of a dispute, to a conventional mediation procedure or any other alternative dispute resolution method.

The competent court in the event of a dispute shall be that of the defendant's place of residence, without prejudice to the Customer's right to bring an action before another court in his capacity as a consumer.

 

The Website complies with French law, and in no case does Arlettie guarantee compliance with local legislation that may be applicable to you when you access the Website from other countries.
