Article 5 – Payment
The price of each Product displayed on the Website includes all taxes, to which delivery charges will be added, as indicated to the Customer before the final validation of his or her Order. The Products ordered do not give rise to any tax refund.
If there is a reference price (crossed out) next to the sale price, it corresponds to the price at which the Product (free of any imperfection) was initially offered for sale by Burberry (in store or online) or a Burberry distributor.
The price of the Products purchased is payable in full on the date Customer places the Order.
Payment shall be made online by credit card (Carte Bleue, Visa, Eurocard/Mastercard, American Express) at the time Customer confirms the Order. Payment by Burberry Gift card is not accepted.
The request for authorization to debit the card is made at the time of the validation of the Order on the Website, except in case of server unavailability. Arlettie reserves the right to proceed with a new direct debit authorization request in the event that the first one could not be completed due to server unavailability.
In the event of non-payment, incorrect address or any other problem with Customer's account, Arlettie reserves the right to block Customer's Order until the problem is resolved.
Arlettie takes all necessary measures to ensure the confidentiality and security of banking data transmitted on the Website. The Website is equipped with an online payment security system that encrypts Customer's data. The payment information is transmitted according to the highest security standards. The transmission of banking data is guaranteed by Arlettie's partner: Shopify Payment. Shopify Payment is a technical service provider; as such, it does not handle disputes related to Orders, which are handled directly by Arlettie.
All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol: this data cannot be detected, intercepted or used by third parties. At no time does Customer's financial data pass through Arlettie's computer system. Shopify Payment verifies that the connection with Customer's browser is secure before sending the payment form to the banking institution that performs the financial transaction.
Customers have the option of choosing PayPal to pay for their Order. After choosing this payment method, Customer will be redirected to the PayPal website. Customer will have to insert his or her identifiers and proceed to the payment.
In accordance with the provisions of Article L.221-11 of the French Consumer Code, Customer will receive, at the latest upon delivery, for each of the Products, written confirmation of the price paid detailing the price of the Products and the delivery charges, if any, payable by Customer.
Article 6 – Delivery
The Products will be delivered to the unique address indicated by Customer at the time of registration provided that it is a shipping location approved by Burberry. Upon delivery, ownership of the Products and the risks attached thereto shall pass to the Customer.
If part or all of the Order cannot be shipped for any reason, Customer will be notified and the balance due will be refunded within seven (7) working days of the cancellation or modification of the Order, as applicable.
In the event that the delivery time is exceeded for reasons other than force majeure, Customer may request - if he/she so desires - the cancellation of the sale and obtain a refund of the sums paid for the sale within a maximum period of thirty (30) days.
Article 7 – Product returns
7.1. Exercise of the right of withdrawal
Withdrawal period – exclusions from the right of withdrawal
In our desire to reduce waste, we draw your attention to the fact that we think it is important that you consider the impact of your purchases and that you do not buy more Products than you are likely to want to keep and then return them after the Event. Please consider your purchases before placing your Order.
You have a right of withdrawal of fourteen (14) calendar days from the date of receipt of your entire Order.
The above-mentioned 14-day period shall run from the day following the delivery of the Order validated by the Customer. This 14-day period shall begin at the first hour of the day following the day of delivery and shall end at the expiration of the last hour of the last day of the 14-day period.
If this period expires on a Saturday, Sunday or public holiday, it is extended to the next business day.
During this period, you may return undamaged Products without having to justify your reasons or pay any penalty. In case of damaged Products received, the return process indicated in Article 7.2 will apply.
The Products must be returned in the condition in which you received them, in their original packaging, intact and complete. They must not have been worn for a long time and must be accompanied by all their accessories, instructions and documentation.
Conditions of withdrawal / return
To exercise your right of withdrawal, you can use the standard withdrawal form available in the "My Account" area, or make any unambiguous statement indicating your intention to return the Product to Arlettie, including by declaring your return online from your account, in the "return and withdrawal" space.
Arlettie will acknowledge receipt of your withdrawal and will allow you to edit your return form.
You must then return the Products to Arlettie, along with the issued return form, no later than fourteen (14) days after your withdrawal, either:
- By post to the following address:
CROSSLOG on behalf of ARLETTIE ONLINE
ZA d’Arvigny
104 rue Denis Papin
77550 MOISSY-CRAMAYEL
- In one of the proposed deposit points, together with the reshipping slip which will be sent to you by e-mail.
The return costs are at your charge. The cost of the prepaid label of your return form (a flat rate of 6€) will be deducted from your refund.
Arlettie undertakes to reimburse you the totality of the sums paid (excluding return costs and subject to the following reservations regarding delivery costs) within 5 days after receipt of the Product in its warehouses. This period may be extended in the event that the return form does not correspond to the returned Order or in the absence of the order number being stated on the return form at the following address:
CROSSLOG on behalf of ARLETTIE ONLINE
ZA d’Arvigny
104 rue Denis Papin
77550 MOISSY-CRAMAYEL
The refund shall be made via the payment method used for placing the returned Order. If the Order is returned in its entirety, the delivery charges that you initially paid (if any) will be refunded. If the Order is returned in part, the delivery charges you originally paid (if any) will not be refunded.
Any risk associated with the return of the product is the responsibility of Customer. It is Customer's responsibility to ensure that the Products are returned to the correct address and in good condition.
7.2. Specific case of a non-conforming Product
Arlettie advises you to check the Product at the time of delivery and in the event that the delivered Product is not compliant (error in the Product or in the quantity delivered, defective or damaged Product beyond the minor imperfections mentioned in Article 8.1 of these Terms and Conditions), to make written reservations no later than within three (3) days following delivery to Arlettie's Customer Service at the address contact.online@arlettie.fr.
In all cases, the provisions set forth in Article 8.1 on statutory warranties will apply, it being specified that considering the aforementioned imperfections, any non-conforming Product delivered can only be refunded (and not replaced or repaired).
In order to allow you to obtain all the necessary assistance in case of delivery of non-conforming or missing Products, please make sure that you keep the package in which the Products were delivered, as well as the documents and e-mails concerning your Order.
7.3. Lost packages
If, within ten (10) working days following the dispatch of the Order, Customer has still not received the package, a delivery notice or precise information via the online tracking system, he/she must go to the nearest post office or parcel delivery point with the tracking number of the package featured in his or her Customer account, or in the confirmation email sent to him/her when the package was dispatched.
If the carrier does not find any trace of the package, Customer must contact the Arlettie Customer Service as soon as possible, either by e-mail at the following address: contact.online@arlettie.fr or, for residents in France, by phone at + 33 (0)1.88.40.36.30.
Arlettie's Customer Service will then open an investigation with the carrier and Customer will receive an e-mail stating that an investigation has been opened.
If the package is found, it will be immediately reshipped to Customer who will be immediately informed. If the package is considered lost, Arlettie will refund the total amount of the Order within fourteen (14) days from the end of the investigation.
Article 8 – Guarantee
All the Products on sale on the Website benefit from the statutory warranty of conformity (Articles L.217-1 and following of the French Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the French Civil Code), allowing you to return any defective or non-conforming Products delivered.
You have a period of two years as from the delivery of the Product to act in application of the statutory warranty of conformity. In such case, considering that the Product is special and has imperfections, you will only be able to obtain a refund against return, and not its repair or replacement in the absence of available stocks for an identical Product.
You are reminded that the statutory warranty of conformity applies independently of any commercial warranty that may be granted to you by the manufacturer or Arlettie.
In addition, if Customer decides to implement the warranty against hidden defects of the thing sold within the meaning of Article 1641 of the French Civil Code, he/she may choose between the cancellation of the sale or a reduction of the sale price. It is up to Customer to prove that the defect (other than the Product imperfections existing upon delivery) existed before the delivery of the Product and was not apparent at the time of delivery.
