ARLETTIE PARIS, a simplified joint-stock company with capital of € 663,337.53, whose registered office is located at 17 Avenue Raymond Poincaré - 75116 Paris and registered in the Paris Trade and Companies Register under number 478 130388 (hereinafter "Arlettie"), a program set up allowing access to exceptional events of prestigious brands in dedicated spaces, accompanied by advantages and services described in the general conditions.

The purpose of these general conditions is to define the conditions of access and use of the services offered to subscribers and the rights and obligations of subscribers when using the services.

Article 2 - Definitions

The terms below used in these general conditions, used in the singular as well as in the plural, will have the following meaning:

CLUB ARLETTIE: All the services offered exclusively to members or VIP members according to their subscription level;

PERSONAL ACCOUNT: Refers to the registrant's account after registering for the services;

ARLETTIE SPACES: Designates the places where the programmed events take place during the duration of the events;

EVENT: Refers to all events of any kind organized by Arlettie (including but not limited to sales, inaugurations, etc.) as part of the services;

REGISTERED: Refers to any natural person using the services and accepting these general conditions;

BRAND: Refers to the partner of Arlettie whose products and / or services offered are the subject of the events;

MEMBER: Refers to any natural person who is a member of the Arlettie club whose membership is subject to the special member conditions;

VIP MEMBER: Refers to any natural person who is a member of the Arlettie club whose membership is subject to the special conditions for VIP members;

SERVICES: Refers to all the services offered to registrants and described in Article 5. Members and VIP members benefit from exclusive services, the conditions of which are described in the applicable special conditions;

Article 3 - Application and enforceability of the general conditions

Registration for the services implies full and unreserved acceptance of the contractual documents that the registrant declares to have read and understood in their entirety and which are as follows, classified in increasing order of priority and forming an indivisible whole:

- These general conditions, including the confidentiality policy available here;

- The special conditions applicable to members and VIP members in the event that the registrant is a member of one of these offers;

- Any document posted in each Arlettie space, including in particular the rules of safety, hygiene, and respect for the places to which registrants will be required, as well as, where applicable, the specific terms and conditions of the event concerned.

In the event of a contradiction between documents of a different nature or of a different rank, the provisions contained in the higher-ranking document shall prevail for the obligations which are in conflict of interpretation. In the event of a contradiction between the terms of documents of the same order, the latest documents shall prevail over the others.

Arlettie reserves the right to modify these general conditions at any time, subject to informing registrants within a reasonable time by any means, it being specified that these modifications will not give rise to any right to compensation or reimbursement, which the registered expressly accepts. The subscriber is therefore invited to regularly consult the general conditions on the site to take note of any changes.

Article 4 - Registration conditions

Registration is intended exclusively for individuals, individuals over the age of 15. Minors are invited to inform the people who have parental authority over them about their subscription and their participation in the events.

Only one account can be opened per person, Arlettie reserving the right to refuse the opening of an account requested by any person who has already been registered.

The services may not be granted to a professional and / or to any person marketing or likely to market the products purchased during events organized by Arlettie or more generally, benefiting from other advantages offered for personal and private purposes.

Registration for the services is done by completing a registration form either online directly on the site or in-store in one of the Arlettie spaces.

Anyone wishing to register must first accept these general conditions in their latest version.

The information marked with one or more asterisks and requested in the registration form is mandatory and essential for the consideration of the registration request.

The registrant guarantees the accuracy of the information provided and will be solely responsible for all the information he communicates. Any change of address, name or other indication that may be necessary must be modified by the registrant by accessing his personal space on the site or in person in our Arlettie spaces. The registrant authorizes all checks concerning his identity and his domicile by Arlettie, without however the latter having the obligation to carry out a systematic verification of all or part of the information received.

The subscriber acknowledges that Arlettie reserves the right to suspend or withdraw the possibility of accessing the services, if the subscriber does not comply with these registration terms and particularly if he provides false or fanciful data. , inaccurate, incomplete, illegible or not updated. The registrant also acknowledges that Arlettie reserves the right to refuse the registration of any person previously registered and / or whose registration has been terminated by Arlettie due to a breach of these general conditions, such as in particular in the conditions referred to in Article 9.2.

Article 5 - Advantage of registration

Registration allows the registrant to benefit from the following services:

- For all registrants: Access to events offered by Arlettie under the conditions set by Arlettie and as communicated to registrants;

- For members and VIP members: services described in the applicable special conditions.

In order to access the services, the registrant and members may be asked:

to justify a personal invitation for the sale concerned which will be sent to him by email,

to pre-register with an option for a proposed available time slot,

download or print documents and present a valid identity document.

It is reminded that the subscriber will also have the possibility of knowing the program and the calendar of sales to which he has access by calling Arlettie customer service, by consulting the site or the Arlettie newsletter.

In order to guarantee privileged access to Arlettie sales, and to secure purchases made, access to Arlettie services is strictly personal and non-transferable. Only minor children and spouses of the registrant or the member will be able to benefit from the access conditions in their presence, and on presentation of proof.

These services are offered within the limits of the capacity of the Arlettie spaces as well as, where applicable, the conditions imposed by the brands, Arlettie partners, in particular because of their own personalized benefit services linked to their products and / or services (niches dedicated to their staff and / or to persons designated by the brands including the organized event).

Article 6 - Intellectual property

The site, brands, logos and any other distinctive sign of Arlettie and / or its partners, and in particular the brands, as well as the content of the site (that is to say, any text, video, photograph or any other information in any format and of whatever nature appearing on the site) are the exclusive property of Arlettie and / or its partners, and in particular the brands, and / or third parties and may be subject to protection, by copyright, trademark law, design law, patent law, or any other intellectual property right. these general conditions do not entail any transfer of ownership of any kind whatsoever to the registrant.

It is therefore forbidden to copy, modify, reproduce, distribute, publish, integrate on any medium whatsoever, adapt, transfer or assign, license, sublicense, give as a guarantee, transmit in any other way. elements of the site or to reverse engineer or use any other method to attempt to access the source codes and / or protocols of the site, without the express authorization of Arlettie or the holder of the rights.

Arlettie grants the registrant only a right of access to the services and to the personal account on a non-exclusive, personal, non-transferable basis and for strictly private use that complies with the provisions of these general conditions.

Consequently, the registrant refrains from any action or any act likely to directly or indirectly infringe the property rights of Arlettie or its partners. This prohibition includes in particular but not exclusively the taking of photographs and videos within Arlettie spaces, which are strictly prohibited.

Article 7 - Liability

Arlettie offers registrants access to private events and exceptions of prestigious brands in dedicated spaces under the conditions described in these general conditions, and online under the conditions described in the conditions of online sales available on the site (e-shop section). Arlettie cannot be held responsible for the products and / or services offered by the brands, the terms of their use or their destination, made available to registrants on the occasion of said events, the latter being set by the brand concerned and described, on the site and / or at the entrance to the Arlettie spaces.

The registrant undertakes to notify Arlettie of any change relating to the data provided and acknowledges that failing this, he will remain solely responsible for any consequences of any kind whatsoever that may result therefrom.

The registrant is solely responsible for his choice to benefit from the services and their suitability for his needs, so that Arlettie cannot be held liable in this regard. Subject to applicable legal provisions, no warranty is granted to registrants by Arlettie. Likewise, products acquired during an event may not be the subject of any return of any kind (exchange, refund, credit note, etc.), unless otherwise stipulated in the special conditions applicable in the event where the registrant would be a member or VIP member of the Arlettie club.

The subscriber undertakes to only benefit from the services and information to which he would have access under the sole conditions defined by Arlettie and for a purpose consistent with the subject of these conditions, public order, good morals and rights of third parties.

In addition, Arlettie informs the registrant that it reserves the right, at any time and for any reason whatsoever, to implement any means allowing to refuse, cancel, suspend or terminate the registration or access to events organized by Arlettie or to cancel the benefit of the services and advantages that he should have obtained, without notice, and, in particular for any conduct, observed or presumed, as being in violation of all or part of these general conditions, any special conditions and more generally of any contractual document, without prejudice to any damage and interest that Arlettie reserves the right to claim from the registrant for compensation for the damage suffered.

Likewise, in the event that the registrant is authorized by Arlettie to be accompanied by one or more persons of its choice, these are the sole responsibility of the registrant. The registrant then undertakes that said persons comply with the conditions referred to in these conditions as well as all the conditions of access to the event concerned and its benefits, Arlettie reserving the right to claim any damage. and interest in compensation for the damage suffered and in particular to the registrant because of one of his guests.

Given the technical IT and telecommunications constraints inherent in the use of the site, Arlettie cannot be held liable in the event of damage caused by a malfunction of one or more of the stages of access to the site and / or to the service offered, due in particular but not exclusively to the inconveniences inherent in the use of the Internet network, such as service interruption, external intrusion, presence of computer viruses or malfunction of any nature whatsoever. The subscriber is invited to report to Arlettie without delay any difficulty that they may notice in the course of their use of the site.

If Arlettie has legitimate reasons to believe that the security of the site is compromised or that a misuse of the services offered is due to an unauthorized use of the subscriber's identification data, Arlettie may temporarily deactivate his personal account to preserve the integrity of the site, as well as that of the data of his personal account. The subscriber agrees to collaborate with Arlettie and in particular to modify his identification data directly on the site by modifying his username, email address and / or password.

Arlettie's liability, whether in tort or in contract, cannot be held liable for acts due to a case of force majeure, a fortuitous event or the act of a third party or the victim of the damage. The registrant acknowledges that, in particular, a fortuitous event is failure and material problems concerning hardware, computer programs and software or the Internet, including, but not limited to interruptions, suspension or closure of the service.

The computerized registers kept in Arlettie's computer systems will be kept under reasonable security conditions and considered as proof of communications between the parties. the archiving of contractual documents is carried out on a reliable and durable medium. Therefore, in order to facilitate their exchanges, the registrant accepts that Arlettie's computer systems and files will prevail between them unless proof to the contrary is provided for his share of at least identical value.

Consequently, the computer files and registers stored in the computer systems operated by Arlettie or on its behalf under reasonable conditions of security and reliability, may be validly used and produced as proof of the execution of these general conditions, and more generally any event, communication or relationship between the parties during the use of the site and the use of the service by the subscriber.

Article 8 - Personal data

By subscribing, the subscriber consents to the use of personal data concerning him by Arlettie under the conditions described in Arlettie's privacy policy accessible here. The privacy policy is an integral part of these general conditions.

It is recalled that the information collected is subject to automatic processing throughout the duration of registration. This information is collected by Arlettie for the purposes of managing its registrants, the business relationship with the registrant, and the organization and monitoring of events. They are likely to be transferred outside the European Union. Everyone has a right of access, rectification or erasure, limitation of the processing of personal data, a right of opposition, as well as the right to define directives relating to the fate of the data in death. Registrants can also withdraw their consent to this processing at any time and file a complaint with a supervisory authority. Anyone registered can exercise their rights with ARLETTIE PARIS - Customer Service - 17, Avenue Raymond Poincaré - 75116 Paris or at the following email address: it is specified that if the registrants exercise their rights listed above, Arlettie may however retain some of the personal information of the registrants and their request to ensure the effective exercise of the rights.

Article 9 - Duration and termination

9.1 Duration

These general conditions are entered into for an indefinite period from their first acceptance by the registrant under the conditions described in Article 3.

9.2 Termination of relations due to Arlettie

Arlettie may immediately suspend access to the site and to the services, in the event of non-compliance with these general conditions by the subscriber. In this case, Arlettie will notify the registrant of this suspension by email.

At the end of a period of eight (8) days from this notification which has remained ineffective, Arlettie may automatically terminate the contractual relationship with the registrant, without formality and subject to the damages to which it could claim. in compensation for the damage resulting for it from this situation.

Notwithstanding the foregoing, Arlettie reserves the right to refuse, suspend or terminate the registration of a registrant without compensation of any kind and without notice, in the event of a serious violation of the conditions required in these general conditions and / or to any document displayed in each Arlettie space as well as, where applicable, the specific terms and conditions of the event concerned, including in particular the rules of safety, hygiene, and respect for the places to which registrants will be required and more generally any contractual document, such as in particular but not exclusively in the event of:

- direct or indirect resale of one or more products purchased on the occasion of an event or a legitimate suspicion of resale of products (in particular but not exclusively: multiple purchases of identical or similar items, photography, distribution on sites specialized…);

- inappropriate or fraudulent behavior, wearing of inappropriate clothing, incivility, provocation or inappropriate, vulgar, disrespectful remarks against Arlettie and / or its partners, including in particular the brands, notoriously contrary to their image, incompatible with the spirit of the place, and / or contrary to public order and / or likely to endanger people such as the premises where Arlettie meetings or events and spaces take place;

- deterioration of materials or non-compliance with products;

- any unjustified incident caused by events organized by Arlettie (such as unruly queues);

- failure to comply with the instructions given.

Finally and in general, Arlettie reserves the right to terminate the registration of any registrant by electronic notification subject to one (1) month's notice.

The termination will result in the prohibition of access to Arlettie events and / or the cancellation of the benefit of the services and advantages that should have been obtained from the registrant, without compensation of any kind.

9.3 Termination of relations by reason of the registrant

The subscriber may terminate these conditions at any time by following the procedure provided for this purpose on the site by logging into his personal space or by making the request within the Arlettie spaces.

Within a maximum period of ten (10) days following this request, the contractual relationship with the registrant will be terminated, the registrant will no longer have access to his personal space, nor to the services and all or part of the data concerning the registrant. may be deleted from Arlettie's databases with the exception of those for which the law requires Arlettie to be kept or under the conditions set by the confidentiality policy.

The termination will result in the prohibition of access to Arlettie events and the cancellation of the benefit of the services that the registrant should have obtained, without compensation of any kind.

In the event of the death of the registrant, and upon production of the relevant supporting documents, the personal account will be deactivated. Its content may only be transmitted to rights holders by court order or under the conditions described in the confidentiality policy.

Article 10 - Force majeure

In the event of a case of force majeure, the performance of the obligations incumbent on the victim of this event will be suspended for its duration, from the date of receipt of the notification by registered letter with acknowledgment of receipt. By force majeure is meant the cases defined by the case law of French courts.

The party invoking the case of force majeure must, as soon as possible, inform the other party.

If a case of force majeure, having been notified, continues for a period of more than thirty (30) days, each of the parties may then, as of right, terminate these general conditions by sending the other party, and this, at any time, a written notification to this effect.

In these circumstances, these general conditions will be terminated automatically, without notice or compensation on either side.

Article 11 - Miscellaneous

The parties agree to perform their obligations in perfect good faith.

The fact that Arlettie does not avail itself at a given time of these general conditions cannot be interpreted as a waiver to avail itself subsequently of any of the clauses of the said general conditions.

If one or more stipulations hereof are held to be not validated or declared as such in application of a law, a regulation or following a decision which has become res judicata of a competent court, the other stipulations will keep all their strength and reach.

In the event of interpretation difficulties resulting from a contradiction between any of the titles appearing at the head of the clauses and any of the clauses, the titles will be declared non-existent.

The parties are independent. Neither party can make a commitment in the name and on behalf of the other party. each party acts in its own name and on its own behalf. None of the stipulations of these conditions may be interpreted as creating between the parties a company, a mandate, an agent or employee to employer relationship.

Article 12 - Applicable law attribution of jurisdiction

In accordance with Article l.152-1 of the Consumer Code, the registrant is offered to use a mediator free of charge for amicable resolution in the event of a dispute arising between him and Arlettie. The registrant is invited to contact Arlettie to inform him of his request, so that Arlettie can communicate the precise conditions of such a request for recourse to this mediation procedure.

These general conditions are governed by French law. In the absence of an amicable agreement, you can refer to the court for any dispute relating to the existence, interpretation, conclusion, execution or breach of these general conditions as well as all the documents related to these general conditions.
